What A Shame...

Post by kitchen king » Fri Jan 30, 2009 12:19 pm

This was in todays paper.... I guess we won't see this 358 for a while.... I always liked to watch him race, he just made a bad choice one night while out with his friends....

York County man charged in crash that killed two
ELIZABETH EVANS -- The York Dispatch
Posted: 01/29/2009 10:52:52 AM EST

Paul William Hively III After 13 months of investigation, Southwestern Regional Police have charged a North Codorus Township man for allegedly killing two friends and injuring a third in an alcohol-fueled crash.
Paul William Hively III, 26, of 3433 Heather Drive, is charged with two counts of homicide by vehicle while driving under the influence, DUI, aggravated assault by vehicle while DUI and three counts of accidents involving death or personal injury. He was in York County Prison Thursday on $100,000 bail.

Police said Hively crashed a vehicle at 1:30 a.m. Dec. 31, 2007, in the 1900 block of Seven Valleys Road (Route 616), a half-mile north of Seven Valleys.

Two people in the car -- Air Force Airman 1st Class Trent Grove, 21, of Sunset Lane in West Manchester Township, and Shelby Winemiller, 21, of Slagel Road in North Codorus Township -- were killed.

A third man, Kyle Maudlin, 21, of York, suffered critical injuries, police said; he was in a coma and has required several surgeries.

According to charging documents, both Winemiller and Maudlin were thrown from the car when it hit the tree. Grove was belted in the front passenger seat, police said.

Police said the red Pontiac GTO, which was owned by Grove, was southbound when it left the right side of the road and crashed into a tree. The car then slid 100 feet before stopping.

Man saw Hively: According to Hively's arrest affidavit, neighbor Blaine Gerver heard the crash, went outside to investigate and saw Hively

walking away from the crash. Gerver asked Hively if he was OK, and Hively asked to use Gerver's phone, police said.
Hively did not call 911, but used the phone to call his father for a ride home, the affidavit states; Hively also told Gerver he'd been at a party and needed a ride home.

When ambulances and police arrived, Gerver physically escorted Hively back to the scene, police said.

Blood test: Hively was treated for minor injuries at York Hospital and released, and his blood-alcohol level was determined to be 0.157 percent, police said. In Pennsylvania, an adult is legally driving drunk at 0.08 percent.

Southwestern Regional Police said Officer Jamie Stalcup had the "arduous" task of determining who was driving, but that based on collision dynamics, evidence including blood spatter and clothing, and Hively's lack of serious injuries, Stalcup determined he was the driver.

Thursday morning, Southwestern Regional and West Manchester Township officers went to Hively's job in the 300 block of South Salem Church Road in West Manchester Township to arrest him.

Hively took off, but was captured after a short foot pursuit, police said. After he was arrested, officers found a small amount of marijuana and a glass smoking pipe in Hively's possession, and charged him for those offenses as well, records state.

this is a shame and it all goes back in how they were raised, these boys were always in some kind of trouble as shelby stole a car when he was 14 and rolled it and killed his best freind at 13

My condolensces to the families.

The fact he called his dad for a ride home is disturbing the most. He obviously didn't care about anyone but himself.

He also raced Williams Grove once or twice.

Some things never change. His personal issues were overlooked and a loss of lifes is a result. This is so horrible. Give him what he deserves.

Whoa, I just now saw this post! Come on now. I, as well as many others probably got into some trouble when we were younger. Maybe not to this extent, but we probably did something. I wouldn't blame it all on parents and say how they were raised.

If you are blaming everything a kid does on their parents, then in your eyes my dad is a bad father? I would highly disagree with you on that one.
